These terms govern your use of Fairlot and the Instant Cash Offer program. By using the site or requesting an offer, you agree to them. Your personal information is handled as described in our Privacy Policy.
1. Website terms
By accessing fairlot.ca (the “Service”), you confirm that you are at least the age of majority in your province or territory of residence and that you have the legal capacity to enter into this agreement. You agree to use the Service in compliance with all applicable federal, provincial, and municipal laws, and not to transmit any malicious code, attempt to gain unauthorized access to any part of the Service, or interfere with its operation. A breach of any of these terms may result in immediate termination of your access.
2. Instant Cash Offer program
An Instant Cash Offer is a conditional estimate generated from the vehicle details, condition, accident history, and photos you provide, together with current Canadian market data. It is not a binding purchase agreement.
- Offers are valid for 7 days from the date they are issued, unless stated otherwise.
- Every offer is subject to an in-person inspection that confirms your vehicle matches the details you provided. If the inspection reveals a discrepancy, you will receive a revised offer before you decide — you are never obligated to sell.
- You represent that you own the vehicle (or are authorized by the owner to sell it), that the information you provide is accurate to the best of your knowledge, and that you will disclose any liens, loans, or leases on the vehicle.
- Offers may be withdrawn where we reasonably believe the submission is inaccurate, fraudulent, or abusive, or where the vehicle cannot legally be sold.
3. Accuracy of information
We work to keep the material on the Service accurate and current, but it is provided for general information only and may contain errors or omissions. Market values change constantly; a valuation shown on the Service today may not be available tomorrow. We reserve the right to correct errors and update information at any time without prior notice, and we are not obligated to update any information except as required by law. Any reliance on material from the Service is at your own risk.
4. Your submissions
When you submit content to the Service — including vehicle details and photographs — you grant Fairlot a non-exclusive licence to use that content to generate your offer, connect you with verified dealers, and operate and improve the Service. You confirm your submissions do not violate any third-party rights and do not contain unlawful, defamatory, or malicious material. We may decline or remove any submission at our discretion.
5. Prohibited uses
You may not use the Service for any unlawful purpose; to submit false or misleading vehicle information; to harass, abuse, or harm another person; to scrape, harvest, or collect data from the Service; to transmit viruses or other malicious code; or to interfere with or circumvent the security features of the Service. We may terminate your access for violating any prohibited use.
6. Third-party links and services
The Service may include content from, or links to, third-party websites and services, including dealer websites and vehicle-history providers. We are not responsible for examining or evaluating third-party content and have no liability for any third-party materials, websites, products, or services. Please review the applicable third party’s policies before engaging in any transaction with them.
7. Disclaimer of warranties; limitation of liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Fairlot, its affiliates, and its dealers shall not be liable for any indirect, incidental, special, or consequential damages — including lost profits or lost data — arising from your use of the Service or any offer generated through it. Nothing in these terms limits rights that cannot be excluded under applicable consumer protection legislation.
8. Indemnification
You agree to indemnify and hold harmless Fairlot, its affiliates, and their respective officers, employees, and agents from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these terms or your violation of any law or third-party right.
9. Termination and severability
These terms are effective until terminated by you or by us. We may suspend or terminate your access at any time without notice if we reasonably believe you have failed to comply with any term. If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute arising from the Service.
11. Changes to these terms
We may update these terms from time to time by posting the revised version on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
